Terms of Service

Effective May 10, 2026

These Terms govern your use of MoseyFam (the “Service”), operated by John Cerdon, doing business as Cerdon AI Solutions (“MoseyFam,” “we,” “us”), a California-based sole proprietorship. Read them carefully. They include an arbitration clause and class-action waiver (Section 22) and a limitation of liability (Section 21). The Service is currently offered in the United States only.

1. Acceptance

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility — minimum age

You must be at least 13 years old to create an account and at least 18 years old (or the age of majority in your jurisdiction) to make any purchase. Persons aged 13–17 may use the Service only with the consent and supervision of a parent or legal guardian. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13 (see Privacy Policy).

3. Account & magic-link authentication

We sign you in by emailing you a single-use link that expires in 15 minutes. You are responsible for keeping your email account secure. Notify us immediately at support@moseyfam.com if you suspect unauthorized access. You can delete your account at any time from /account.

4. The Service

MoseyFam aggregates third-party data (Google Maps Platform, Ticketmaster, curated community calendars, and others disclosed in our sub-processor list), and uses Anthropic’s Claude language model to draft a 3–5-stop family-day-out itinerary based on filters you provide. The output is a suggestion, not a reservation, ticket, or guarantee.

5. AI-generated content disclaimer

MoseyFam itineraries are generated by artificial intelligence using third-party data sources. AI may produce inaccurate, incomplete, or out-of-date suggestions. You agree to verify hours, prices, age suitability, and availability directly with each venue before traveling. The AI features of MoseyFam are not a natural person or entity with legal authority to make agreements on your behalf, and MoseyFam makes no claims or warranties as to the accuracy of any AI-generated recommendation.

6. Third-party content — venue, hours, and event accuracy

Venue conditions, hours, prices, age requirements, and event details are provided by third parties and may change without notice. Events may be canceled, postponed, or modified by venues or organizers without notice to MoseyFam. We strongly urge you to confirm details directly with each venue or organizer before you go. MoseyFam expressly disclaims any responsibility or liability for any inaccuracies in any data accessed through the Service regardless of cause; for the conduct of any venue, organizer, or other third party; or for any error, omission, interruption, deletion, defect, or delay.

7. No reservation guarantee

MoseyFam does not sell tickets, take reservations, or guarantee admission to any venue or event. Each venue is solely responsible for the price, availability, accessibility, age policies, and conditions of any product or service it offers.

8. Inherent risk of activities; supervision of minors

Read this section carefully.

Activities recommended through MoseyFam can involve risk of injury, illness, death, or property damage. These risks may include but are not limited to: falls; weather conditions; traffic and parking-lot hazards; water, pool, and beach hazards; playground equipment failures; allergens, including food allergens at restaurants and animal allergens at attractions; communicable disease exposure; wildlife and pet encounters; and the negligence of venues, operators, or other participants. You assume all such risks. MoseyFam cannot and does not assume responsibility for any personal injury, death, illness, or property damage resulting from your use of any recommendation. Exercise your independent judgment, assess your family’s physical capability and any equipment needs, account for prevailing weather, and use the Service at your own risk.

You are solely responsible at all times for the safety, supervision, and well-being of any minor child in your care during any activity recommended by MoseyFam. You acknowledge that you are best positioned to assess whether any recommended activity is appropriate for your child’s age, ability, allergies, medical needs, and any other circumstances. By using MoseyFam to plan an activity for a minor, you certify that you have the authority to make decisions on behalf of the minor and you agree to release, hold harmless, indemnify, and defend MoseyFam from all liabilities and claims arising from the minor’s participation in any activity.

9. Geographic scope

The Service is currently offered in the United States. We make no representation that it is available, lawful, or appropriate elsewhere; if you access from outside the U.S. you do so on your own initiative and are responsible for compliance with local law.

10. Third-party services pass-through

Some features rely on third-party services with their own terms. Maps, place data, photos, and reviews are provided through Google Maps Platform; your use is also governed by the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. Itinerary text is generated by Anthropic’s Claude and is subject to the Anthropic Acceptable Use Policy.

11. Payments & pricing

Web payments are processed by Stripe, Inc. iOS in-app purchases are processed by Apple through StoreKit and are additionally governed by Apple’s Standard Terms of Use (EULA); in the event of any conflict between these Terms and Apple’s EULA with respect to an iOS purchase, Apple’s EULA controls as to that purchase. Pricing and the units of the product (pack day-counts, subscription period) are shown at checkout. iOS prices may differ from web prices to absorb the platform’s service fee. Pack credits expire 12 months after purchase.

The MoseyFam Family subscription is an auto-renewable subscription. It renews automatically at the price shown at checkout for the chosen interval (currently one month) unless cancelled at least 24 hours before the end of the current period. iOS subscribers manage and cancel through their Apple ID Subscriptions settings; web subscribers manage and cancel from /account.

12. Refunds

Day-pack credits are digital goods delivered immediately on purchase. Unused credits are refundable within 14 days of purchase by emailing support@moseyfam.com. Family subscriptions can be cancelled any time at /account; cancellation takes effect at the end of the current billing period. iOS purchases are also governed by Apple’s refund policy at reportaproblem.apple.com. 13. User submissions

If you submit content (e.g. an email reply, support ticket, or saved-plan title), you grant MoseyFam a non-exclusive, worldwide, royalty-free license to use, store, and display that content as needed to operate the Service. You retain ownership.

14. Acceptable use

Don’t scrape the pipeline, don’t abuse the planner with automated traffic, don’t impersonate another user, don’t attempt to circumvent paywall or rate-limit logic, and don’t use the Service for anything illegal.

15. Intellectual property

The Service, including its design, code, logo, and editorial copy, is owned by MoseyFam and protected by U.S. and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes consistent with these Terms.

16. DMCA notice-and-takedown

If you believe content on MoseyFam infringes your copyright, see /dmca for our designated agent and notice procedure under 17 U.S.C. §512.

17. Account termination

We may suspend or terminate your account at any time for violation of these Terms or to protect the Service. You may delete your account at any time from /account. Upon termination, we delete your account data within 90 days, except where retention is required by law (for example, payment records for tax purposes) or for legitimate security and fraud-prevention purposes.

18. Indemnification

You agree to indemnify, defend, and hold harmless MoseyFam, its directors, officers, employees, and contractors from any claim, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, your violation of applicable law, or your infringement of any third-party right.

19. Disclaimer of warranties

The Service is provided “AS IS” and “AS AVAILABLE,” without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, MoseyFam disclaims all such warranties.

20. Limitation of liability

Read this section carefully.

To the fullest extent permitted by law, MoseyFam will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or anticipated savings, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. MoseyFam’s aggregate liability for any claim arising out of these Terms or the Service is limited to the greater of (a) the fees you paid MoseyFam in the 12 months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

21. One-year limitations period

Any cause of action arising out of or related to the Service must be commenced within ONE (1) YEAR after the cause of action accrues, or it is permanently barred. This bars longer statutory periods to the extent allowed by law.

22. Dispute resolution — binding arbitration; class-action waiver

Please read carefully. This section affects your legal rights.

You and MoseyFam agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by National Arbitration and Mediation (NAM) under its Comprehensive Dispute Resolution Rules and Procedures and, where applicable, the Supplemental Rules for Mass Arbitration Filings. Arbitration takes place in California unless we agree otherwise; the arbitrator’s decision is final and binding. The Federal Arbitration Act governs the interpretation and enforcement of this Section.

You and MoseyFam waive the right to a trial by jury and the right to participate in a class, group, consolidated, or representative action.

30-day opt-out: you may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms, including your account email and a clear opt-out statement, to support@moseyfam.com.

Carve-outs: small-claims court actions, requests for injunctive relief related to intellectual property, and California PAGA representative actions to the extent non-waivable are exempt from this Section.

23. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. For any dispute that is not subject to arbitration, exclusive jurisdiction and venue lie in the state and federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.

24. Severability and miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver. These Terms, together with the Privacy Policy and any documents they reference, are the entire agreement between you and MoseyFam with respect to the Service.

25. Changes

We may update these Terms. Material changes will be announced by email or on this page at least 10 days before taking effect. Continued use after the effective date constitutes acceptance.
